The Endangered Species Act requires Interior and Commerce to determine whether or not a species warrants an endangered or threatened listing based solely on the science, without consideration of economic impacts. Previously, agency regulations also required such decisions to be made “without reference to possible economic or other impacts of such determination.” In addition to the final joint regulations, the U.S. Fish and Wildlife Service finalized a separate revision rescinding its “blanket rule” under section 4(d) of the ESA. The rule had automatically given threatened species the same protections as endangered species unless otherwise specified. Section 4 (d) of the ESA authorizes FWS and NMFS to issue regulations “necessary and advisable” for the conservation of threatened species.
